Terms of Use

1. Who we are and what these terms cover

Ananui ("the app") is provided by Anima Sound Productions Limited, registered in England and Wales under company number 04671435, whose registered office is at Derringstone House, Derringstone Street, Barham, Canterbury, Kent, CT4 6QB ("we", "us", "our").

These terms are a contract between you and us. By downloading or using the app you accept them. If you do not accept them, please do not use the app.

Our Privacy Policy explains how we handle your personal data and forms part of these terms.

2. Using the app

You must be at least 16 to use the app and to create an account.

You are responsible for your account and for keeping your sign-in details secure. Please tell us at once if you think someone else is using your account.

You may delete your account at any time under Profile → Delete account, or by following the steps at animamusic.uk/account-deletion.

3. What we give you

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app, and to listen to the music available to your subscription tier, on devices you own or control.

You are licensed to listen. You do not own the music. Buying a subscription, or downloading a track for offline listening, does not transfer ownership of any recording or composition to you.

4. Personal use, and how to license other uses

The music in the app is for your own personal, non-commercial listening.

Without a separate written licence from us, you may not:

  • play the music publicly, or in any business, class, studio, treatment room, event or venue
  • include the music in a video, podcast, livestream, film, game or any other production
  • copy, share, sell, rent, lend, broadcast or redistribute the music
  • share your account or sign-in details with anyone else
  • extract, rip, record, or attempt to download the audio by any means other than the app's own offline feature
  • circumvent, remove or interfere with any security or access-control measure
  • reverse engineer, decompile or attempt to derive the source code of the app, except to the extent the law says you may

If you want to use the music in a class, treatment room, business, video or any public setting, we will usually be glad to license it. Email licensing@animamusic.uk and tell us what you have in mind.

5. Free and paid tiers

Some of the app is free. Some content and features require a paid subscription.

We may change what is included in each tier, add or remove music, and change or discontinue features. We will not do this in a way that makes a subscription you have already paid for substantially worthless, and where a change is significant we will tell you in advance.

Music may occasionally become unavailable for reasons outside our control, including changes to the rights we hold.

6. Subscriptions, billing and cancellation

Subscriptions are sold and billed through the Apple App Store or Google Play, not directly by us. Their terms apply to the transaction, and we never receive or store your payment details.

Subscriptions renew automatically at the price shown at purchase, until you cancel. Your account is charged for renewal within 24 hours before the current period ends.

Free trials. Where a free trial is offered, it converts to a paid subscription automatically at the end of the trial unless you cancel at least 24 hours before it ends. Unused trial time is forfeited when you buy a subscription.

Cancelling. Cancel at any time through your store account:

  • Apple: Settings → your name → Subscriptions → Ananui → Cancel
  • Google: Play Store → profile icon → Payments and subscriptions → Subscriptions → Ananui → Cancel

Cancelling stops the next renewal. You keep access until the end of the period you have paid for. Deleting your account does not cancel your subscription — you must cancel it separately.

Prices vary by country and may change. We will give you notice of a price rise before it takes effect, and you may cancel if you do not accept it.

7. Refunds and your cancellation rights

Refunds are handled by Apple and Google, under their own policies, because they process the payment. Request one through your store account. We can pass a request on but we cannot process it ourselves.

Your legal right to cancel. As a consumer buying digital content at a distance you normally have 14 days to change your mind. That right ends once streaming or downloading begins, where you have consented to it starting immediately and acknowledged that you lose the right to cancel. By starting to listen, you give that consent and acknowledgement.

Nothing here affects your statutory rights, including your right to a remedy if the digital content is faulty, not as described, or not of satisfactory quality.

8. Listening safely, and what this music is not

The music in this app is for listening, rest and personal practice. It is not a medical treatment and it is not a substitute for professional healthcare.

Words such as "sound medicine", "medicine music", "healing" and "ceremony" describe a musical tradition and a listening experience. They do not describe a clinical outcome. Nothing in this app diagnoses, treats, cures or prevents any medical or psychological condition, and nothing in it should be taken as medical advice.

If you have a health concern, speak to a qualified healthcare professional. Never delay or disregard medical advice because of anything you have heard or read here.

Do not listen while driving or operating machinery, and take particular care with sleep timers and long-form sessions. Please listen at a comfortable volume; prolonged listening at high volume can damage your hearing.

9. Content you provide

If you send us feedback or suggestions, you agree we may use them freely without obligation or payment to you.

10. Our intellectual property

All music, recordings, artwork, text, design and software in the app belong to us or to our licensors, and are protected by copyright and other laws. Nothing in these terms transfers any of those rights to you beyond the licence in section 3.

"Ananui" and "Anima Sound Medicine" are our trading names.

11. Suspending or ending your access

We may suspend or end your access if you materially breach these terms, particularly section 4, or if we are required to by law. Where it is reasonable to do so we will warn you first and give you a chance to put things right.

If we end your access because of something you have done wrong, we are not obliged to refund you. If we end it for any other reason, we will refund the unused part of your current subscription period.

You may stop using the app at any time.

12. Things we cannot promise

We work to keep the app available and working, but we do not promise it will be uninterrupted or error-free. Audio streaming depends on your internet connection and your device, which are outside our control.

We may carry out maintenance, and we may update the app. Some updates may be needed for it to keep working.

13. Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Your statutory rights as a consumer are not affected.

Subject to that:

  • We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
  • We are not liable for business losses. The app is supplied for private use, and if you use it for any commercial purpose we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
  • Where our liability can lawfully be capped, it is limited to the amount you have paid us for the app in the 12 months before the claim arose.

14. Changes to these terms

We may change these terms. If a change is significant we will tell you in the app or by email before it takes effect. If you do not accept a change, you may cancel your subscription and stop using the app.

15. Apple and Google

These terms are between you and us, not between you and Apple or Google.

Apple and Google are not responsible for the app or its content, and have no obligation to provide any support or maintenance for it. Any claim relating to the app should be directed to us at the address below.

If the app does not conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation in respect of the app.

You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. General

If any part of these terms is found to be unenforceable, the rest continues to apply.

If we do not immediately insist that you do something you are required to do under these terms, that does not prevent us from doing so later.

You may not transfer your rights under these terms to anyone else. We may transfer ours if the business is sold, and we will tell you if that happens.

17. Law and disputes

These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales.

If you live in Scotland or Northern Ireland, you may also bring proceedings in your own country's courts. Nothing here removes any protection you have under the consumer law of the country where you live.
